Who Should Register?

Registration provides protection. Consider registering your copyright if:

  1. You are publicly displaying your work for the public online on sites like YouTube, Vimeo, or a blog.

  2. You are shopping around a script or treatment to agents or uploading it to The Black List.

  3. You are a musician distributing through Soundcloud or using a service to get on iTunes and Spotify.

  4. You are self-publishing or promoting a book to publishers.

The Benefits of Copyright Registration

Copyright registration provides a number of benefits to any author or creator of a work. Registering your creation may grant you the following benefits:

  1. ABILITY TO SUE: Without a copyright registration it becomes very difficult to protect your work. If someone steals your creation and you want to sue them for money or to get the court to order them to stop, you will need to register first.

  2. GIVES YOUR RIGHTS TEETH: A cease-and-desist or takedown notice might not be enough if the infringer knows you can't take them to court.

  3. EVIDENCE OF OWNERSHIP: It can be difficult to prove that you actually own a work in the middle of a dispute. Mailing a copy to yourself provides no real protection. But registering with five years of publication does.

  4. MORE MONEY: Registration may give you access to statutory damages, money that the court orders an infringer to pay per work infringed. These are only available if the work is registered before the infringement or within three months of publication. This means

It is best to register before your work is stolen
